Applicant Privacy Notice - California Residents

This Applicant Privacy Notice ("Notice") applies to California residents who have applied for employment ("Applicants" or "you") at Miami Labs, Inc. ("OpenStore"). As part of our recruiting and hiring practices, we collect and process personal data relating to Applicants.

This Notice describes the types of personal information that we collect and process about Applicants, and why we collect and process that information. It does not cover the personal information we collect about consumers or from our clients.

We respect the privacy rights of individuals and are committed to handling personal information responsibly and in accordance with applicable law. If you have any comments or questions about this Notice, please contact us as described in Section 5 below.

  1. Types of Personal Information We Collect about You

    1. In the course of your relationship with OpenStore, we may process personal information about you. The types of personal information we may process include, but are not limited to:

      1. Identification data (e.g., name, photograph);

      2. Contact details (e.g., home address, telephone number, email address):

      3. Employment details (e.g., current and prior job titles/positions and employers, qualifications, performance, skills, experience, and any other information provided on your resume or CV):

      4. Work authorization status;

      5. Interview-related travel and accommodation information: and

      6. Information obtained in connection with a background check (e.g. criminal records and financial information, if applicable).

    2. There may also be situations where you provide us with sensitive personal information like your race, ethnicity and gender or information about disabilities you may have so that we can comply with anti-discrimination laws and government reporting obligations, provide reasonable accommodations, and/or ensure equal employment opportunities.

  2. Sources of Personal Information

    In most cases, the information we collect about you is provided by you in the first instance, but there may be situations where we collect personal information from other sources, as well. The following are other potential sources of information, and examples of the types of information we may receive from those sources:

    1. Third-party services like Greenhouse, Lever, AspenHR, Linkedin, GitHub and other recruiting services providers may display or disclose your identification data, employment history, and work samples;

    2. References may disclose information regarding your employment history and work performance;

    3. OpenStore employees may provide feedback in the course of evaluating your candidacy; and

    4. Our and our third-party providers' information technology systems may collect information about your interaction with those systems (e.g., our applicant tracking systems may reflect that you've applied for a position or submitted documentation associated with your candidacy).

  3. Purposes for Processing Personal Information

    1. OpenStore collects and uses your personal information primarily for the purpose of managing our relationship with you (e.g., to evaluate your application for employment), and for other internal business purposes like record keeping. Processing data from Applicants allows us to manage the recruiting process, evaluate a candidate's suitability for employment, and make decisions around offers of employment.

    2. OpenStore may also collect and use personal information when it is necessary for other legitimate purposes. For example, we may process your personal information to investigate breaches of our own internal policies.

    3. OpenStore may also use and disclose your personal information where we consider it necessary to comply with laws and regulations (e.g., for anti-discrimination laws), under judicial authorization, or to exercise or defend the legal rights of OpenStore and its parent companies, subsidiaries, affiliates, joint ventures, and other companies under common control, as applicable.

  4. Parties with Whom We Share Your Personal Information

    1. OpenStore does not sell your personal information and takes care to allow access to personal information only to those who require such access to perform their tasks and duties, and to third parties that have a legitimate purpose for accessing it. Whenever we permit a third party to access personal information, we have or will implement appropriate measures to ensure the information is used, and that the confidentiality and integrity of the information is maintained, in a manner consistent with this Notice.

    2. We may share your personal information OpenStore’s subsidiaries, affiliates, joint ventures, parent companies and other companies under common control for recruiting as well as other legitimate business purposes (e.g., IT services/security and general business management).

    3. We make certain personal information available to third parties that provide services to us, for example, to contact your references or conduct background checks. We do so on a "need to know basis" and in accordance with applicable law.
